spousal maintenance rules

New rules for spousal support have been in effect since January 1, 2020, but not everyone is aware of this. Because what is it really like now?

Foundation for Free Divorce will tell you!

From now on, spousal support will be for a maximum of 5 years or less. If the marriage or registered partnership lasted less than 10 years, the ex-partner will receive spousal support for half of the time that the marriage or registered partnership lasted.

There are 3 exceptions to this, which we will explain for you below:

1) If you have children together, spousal support only stops when the youngest child turns 12.

2) If the marriage or registered partnership lasted at least 5 years and the ex-partner who receives alimony receives AOW within 10 years, the alimony obligation lasts until the recipient receives AOW.

3) Were you born on or before January 1, 1970? Did your marriage or registered partnership last longer than 15 years? Feedback Will you only receive AOW in more than 10 years? Then the alimony term is a maximum of 10 years.
