Free divorce is possible if you are entitled to subsidized legal assistance. The Dutch government believes that everyone has the right to legal assistance, even if you are getting divorced and do not have the money to hire a lawyer yourself. Do you have a low to average income and have decided to divorce? Do you want to prevent a contested divorce and arrange everything in good consultation? If you meet the conditions of the Legal Aid Board, divorce is 100% free. We are unique in the Netherlands in this! At all other authorities you still have to pay personal contributions and/or court fees. Not with us! We are happy to explain how this works.

Conditions for free divorce

To qualify for a free divorce and subsidized legal assistance, you must meet a number of conditions. This takes into account:

The taxable income of both of you

assets

Your intention to separate amicably

The income conditions change annually and the maximum amount also depends on the living situation. Do you live under the same roof with minor children? Then the taxable income may be a lot higher. We submit the application for the subsidized divorce to the Legal Aid Board.

The amounts of the Legal Aid Board as of January 1, 2024 are:
Taxable income or aggregate income:

1 person without children € 31,100 per person,
married, cohabiting or single-parent family € 44,000 per person.

The equity is set at € 18,476 per person.

The year in which the Legal Aid Board will look at your taxable income and assets is 2022.

Married, registered partners or cohabitation contract

Whether you are married or registered partners, the consequences of breaking up do not differ much in terms of content. We explain how this works:

Marriage: a marriage is ended with a divorce through the court. This is final from the moment the divorce decree is registered in the registers.

Legal separation: the marriage continues, but you separate. This separation is often used for religious reasons.

Registered partnership: a registered partnership is dissolved through the court with a decision if you have children. If there are no children, a statement from a lawyer or notary is sufficient.

Cohabitation contract: officially you do not have to dissolve anything, but the consequences of breaking the relationship depend on what is included in the contract.

Breaking up cohabitation without a cohabitation contract: if there are minor children, a parenting plan is drawn up that must be issued by court order.
